Kathmandu : The Election Commission has said that it was surprised over the allegations levelled against it of ‘delaying to make the people’s mandate public’ even though it is working as required to make the House of Representatives and State Assemblies’ election public.
Issuing a six-point statement here Wednesday, the Commission has made it clear that despite its eagerness to make the results public it was not possible due to constitutional and legal hurdles without the result of the election of the member of National Assembly.
The House of Representatives election Act, 2074 provides that the EC has to submit a report on the election the Pradesh Pramukh or head of province within seven days of announcement of the including the results of the FPTP and PR system of elections. And accordingly, the Commission has repeatedly drawn the attention of the government to appoint the head of provinces soon.
Furthermore, as per Article 84 (8) of the Constitution and HoR member Act 2074 Clause 60 (4), the Commission is not in a position to communicate to the parties to recommend names of the candidates to be elected under the PR category without the election of the National Assembly, the statements adds.
The Commission has expedited the preparation for the NA election after an ordinance on the same was certified by the President and it is the government that announces the date for the election, for which the EC has been urging the government.
In the statement, the Commission also appeals to all concerned to not ignite the situation and cause disrepute to the Commission by ignoring the procedures set by the Constitution and the legal for announcing the election result.
